Contract

SALES TERMS AND HEALTH GUARANTEE
(You Can Also Download PDF)

Welcome to the select few who have the joy of owning one of the world’s most lovable creatures. We at NoCoatKitty put our cat’s needs first; we want you to do the same!

The seller and buyer agree to the following

NoCoatKitty uses ONLY Merial Pure Vax 3 to vaccinate their kittens and cats. If you
choose to vaccinate with any other vaccines you do so at your own risk and contract will be null and void. If your vet does not carry Merial I will gladly order and have it shipped to you. FIP and FeLV vaccines are NOT RECOMMENDED. If buyer vaccinates for FIP or FeLV contract will be null and void. There are links on my website that explain why these vaccines are DANGEROUS! This kitten is to the best of our knowledge, healthy at the time of sale and has had the following vaccinations and/or tests: SEE HEALTH RECORDS

NoCoatKitty requires a $500 deposit per kitten/cat, which is non-refundable to reserve kitten/cat. This deposit will go towards the total agreed upon price. Payments are to be made in form of Money Order, bank issued Cashier’s Check, or Cash-Payable to Tracy Brennan.
Payments made by PalPal: traann6853@aol.com (a 4% fee must be added to sale price to cover PayPal Fees)

This cat/kitten is to be of sound health upon arrival. It is guaranteed for a period of 72 hours if vet checked within that time or contract will be in breach. It is recommended that the new cat be kept in quarantine during this time. If it is found medically deficient with an untreatable or life threatening illness, buyer must notify the seller immediately with letter/fax from the examining veterinarian. Upon its return, it will be replaced with another cat/kitten. If one is not available the buyer will be placed first on waiting list or full refund of kitten.

The breeder is not responsible for cats lost or stolen after acceptance by the airline carrier. It is the responsibility of the purchaser to file a claim in the event of loss, injury, or death of cat.

Buyer agrees to have Nocoatkitty’s kitten Spayed or Neutered by 5lbs or 6 months
of age which ever comes first, at buyers expense. Papers WILL NOT be released until proof from your vet is provided that the cat/kitten has been sterilized. If cat/kitten is not spayed/neutered by 6 months of age,
seller will enforce breach of contract for the maximum dollar amount ($2500 which is the amount that kittens are sold with full rights). If said Cat/kitten is bred any offspring of this kitten are to be delivered to the breeder as the breeder's sole property, and the breeder may also reclaim this cat without refund.

NoCoatKitty does not give permission to breed said cat/kitten. Kitten is still registered under breeder until proof of spay/neuter.
INITIAL:

WHY FIX YOUR KITTY BY 6 Months? Males unfixed tend to spray! This spraying can ruin your carpet, furniture, and even your walls. Fixing a boy before the age of 6 months will stop him from starting this behavior.

Females unfixed can develop a serious condition called PYOMETRA...The two main hormones produced by the ovaries are estrogen and progesterone. An excessive quantity of progesterone, or estrogen can cause pyometra. Cysts can form in the lining of the uterus. At this point, the condition is called 'endometrial hyperplasia,' and generally, the cat will not show signs of disease. As these cysts containing numerous secretory cells grow, large quantities of fluids are produced and released into the interior of the uterus. Bacteria commonly colonize the uterus by entering through the cervix. This produces an even greater response by the body, as it showers additional fluid and white blood cells into the affected organ. The condition is then called 'pyometra.' The body will attempt to eliminate the problem by carrying the wastes and excess fluid through the bloodstream to the kidneys. However, the amount of material in a cat with pyometra is too great to be eliminated in this fashion, overloading the kidney system. The normal toxins that should be excreted from the body build up, and the animal goes into uremic poisoning. Untreated, she will die from kidney failure. Sphynx are VERY prone to pyometra... fixing a female before 6 months old will eliminate this problem!

It is understood that the degree in hairlessness in a Sphynx vary from cat to cat and that no feline is completely hairless. Fur on tail, feet, and face is common. Furthermore, it is understood that hormones and genetics play an important roll in hairlessness and that even though a Sphynx kitten may be almost hairless when sold it is possible said kitten could develop some hair after being Spayed/Neutered or as they grow older. Reasons include but not limited to: weather and climate, and hormonal changes can have a bearing on growth.

Cat/kitten will be kept indoors as a loved member of the family. Cat/kitten will not be caged as a primary living arrangement.

If for reasons other than the animal’s health you cannot retain ownership of the cat/kitten, the breeder will be given the right of first refusal as surrender.
No kitten/cat from this cattery may be sold privately, given to an animal shelter, sold or given to pet store, abandoned, or sold or given to a laboratory for experimental purposes.

Seller is not responsible for any Vet bills incurred once cat/kitten is in buyer’s possession. Upon its arrival, buyer needs to take the said cat/kitten to be checked by their qualified licensed Veterinarian, within 3 days, or contract will be in breach.
The cat/kitten is guaranteed against congenital defects up until it’s one year old. Should it die within this time due to a congenital defect the kitten/cat will be replaced by one of the same quality and value when next available, only if necropsy has been preformed and a certificate from your vet is provided as proof of the cause of death.

The cat/kitten will not be denied needed veterinary attention. If the owner is unsure whether or not the animal is in need of medical services, a veterinarian will be contacted, the situation explained, and the veterinarian’s advice will be acted upon. The cat/kitten will not be allowed outside. These cats can get sunburn or get hypothermia.

This cat/kitten is not to be destroyed for any reason other than terminal illness or injuries approved by veterinarian.

If this cat/kitten is going into a multi-pet household the breeder/seller will not be responsible for any illness or vet bills that occur due to the exposure between the cat/kitten and the resident pets.

The cat/kitten WILL NOT be de-clawed INITIAL___________. De-clawing is an inhumane mutilation. It consists of amputation of the first knuckle. Weekly nail-clippings, gentle discipline along with the availability of a scratching post or mat will eliminate scratching problems. TAKE THE TIME TO TRAIN YOU KITTY.
The cat/kitten will receive frequent and kind human attention. Please use logic in interacting this cat/kitten with other animals or young children.

This cat/kitten will be given the proper diet in the proper amount, and will have fresh water and clean litter boxes available at all times.

If buyer having put a deposit on a cat/kitten should later change their mind about the purchase, the deposit will not be refunded. If, however the cat/kitten should die before the buyer picks up cat/kitten, Nocoatkitty Cattery will replace it with one of equal quality and value. If one is not available, the buyer will be placed first on a waiting list or full refund will be returned to buyer. If for any reason the buyer needs to find said kitten/cat a new home, seller has first option to receive the cat/kitten back. This right is not time limited, but remains in effect for the life of the said cat/kitten.

If this cat or kitten is purchased as a breeder male, purchaser agrees not to resell this cat for stud unless approved by the seller.

If this cat/kitten is purchased as a breeder female, purchaser agrees not to resell this cat/kitten for use as a breeder to anyone unless approved by seller.
Seller makes no guarantees as to fertility or performance of cats or kittens when purchased for breeding/showing.

If this cat/kitten is purchased as a breeder, purchaser agrees to use good judgement in the breeding, and to always breed for healthy, quality kittens of good temperament, that are a good representation of the breed.

BREACH OF CONTRACT

In the event the purchaser is found to have violated any of these terms and conditions of this contract, the cat/kitten is to be surrendered unconditionally to the seller. Seller may reclaim physical and legal ownership of cat/kitten with or without due process of law for any breach of contract with no refund of purchase price.

FACSIMILE SIGNATURES: A facsimile signature shall be enforceable as an original if the original contract is lost, destroyed or otherwise unavailable. In the event the Purchaser is found to have violated any of the terms of this contract, Purchaser shall be liable to the seller for damages in the amount of two times the purchase price of said cat/kitten, plus expenses for veterinarian care upon return of cat/kitten to seller, and all attorney, legal and related miscellaneous fees that result in litigating this contract. Any legal action, which may arise under the terms of this contract, will be brought in the county/city of breeder’s residence.

VENUE: If any legal action is commenced by Buyer or Seller as a result of this contract, Buyer agrees that the place of venue for such action shall be Washington Township, State of New Jersey. Buyer assents to personal jurisdiction within such venue regardless of their place of residence and agrees that any judgment obtained is enforceable within the jurisdiction that they reside in as if obtained within that jurisdiction.

This document is a legal and binding contract. This contract is to be governed by the laws of the State of New Jersey. Seller and Purchaser signatures indicate full agreement and approval of all the above terms and conditions of this contract.
There are no other conditions or guarantees, verbal or implied. No verbal deviations or additions are valid. No other warranties or guarantees are provided other than those specifically outlined above.

CARE FOR NEW KITTY

Eyes:
Sphynx tend to have eye boogers as they do not have eyelashes to protect their eyes from dirt. You may cleanse around their eyes with a warm wet cotton ball or a warm wet wash cloth. If you notice redness, swelling or yellow discharge please see your vet.

Ears:
Sphynx will also have a black waxy buildup in their ears. This is again normal for the breed and it is usually NOT ear mites. You may use baby wipes to remove this buildup or an ear cleaner from your local pet store. A small amount of ear cleaner added to the end of a Q-tip will get that wax build up right out. Please avoid harsh cleansers as sphynx may be sensitive and have an allergic reaction to them. Also be careful when using cotton swabs to not push any wax back into the ear canal as this may lead to infection.

Nails:
Sphynx should have their nails trimmed and cleaned regularly. When clipping nails be sure to avoid clipping into the pink vein area inside the nail as this causes discomfort to your kitten. You may use a regular toenail clipper for kittens and a cat clipper on adults. Sphynx will get a black waxy buildup on their nails and this is normal for the breed. It works best to clean them with baby wipes or hypoallergenic pet wipes.

Diet:
We at NoCoatKitty feed our carnivores the most natural diet we can The Raw Diet. We grind our human grade meats right in our home. We suggest you continue to do the same. If you do not have a grinder there is a great website to purchase already ground meats at www.hare-today.com. I am more than happy to answer any questions you have about feeding raw to your new family member:-) I also have links on my website if you would like to browse. If you do not wish to feed raw than please consider a very natural no grain diet for you kitty. I recommend EVO (wet) and Orijen (Dry). I purchase this food at www.petfooddirect.com

The best supplements out there are created by NuVet Labs and can be found at www.nuvetlabs.com specifically NuVet Plus for Cats.

Bath Time!!!!
Your sphynx should also be bathed every month. Many breeders recommend weekly baths. The sphynx breed secrete natural oils and this causes dirt to build up and will lead to a stinky baby...so over-bathing could cause more harm than good!!! Baby wipes that do not contain alcohol are great for touch ups.

Vet:
Be sure to find a vet who is familiar with the sphynx breed!!!

VACCINES:
Please be sure to give your kitten Merial vaccines, that do not contain the heavy metals that other vaccines contain. We give the 3 way Purevax from Merial. Never give FIP or FELV vaccines to your kittens and cats. And never give two different vaccines on the same day unless it is a combo vaccine. It is too hard on your little kitten and many cats have had severe reactions to two vaccines given on the same day. FIP vaccines are often time fatal if your cat has ever been exposed to the corona virus, which 90% of cats in a multiple cat household have been exposed. They will break out with the fatal form of FIP if given the vaccine. There is no known treatment for FIP it is fatal.

Sphynx are very loveable and affectionate cats. Some people have described them as part monkey, part dog and part cat. Be ready and willing to have a pet who wants to be at your side always and follow you around like a puppy. They also tend to be part parrot as it is typical for the breed to climb up your back and sit on your shoulders whenever they get the chance!!! You will not be lonely or lack entertainment with a sphynx for a pet. Two are better than one, I always say. They are a bit addictive and you can't have just one!!!!!

Kitty Litter: I use Fresh Step Scoopable Litter:)

Vomiting & diarrhea:
Seek your vet's counsel immediately for watery stools or vomiting, as kittens can get dehydrated and can die very quickly if not treated promptly!!!! This can come about from an abrupt change in their diets, intestinal infections or poisoning. For cats or kittens with loose stools, it may help to add fiber to the diet, such as Iams hairball formula cat food or use the Science Diet ID formula from your vet. It also helps to boil hamburger and rice, about 2/3 rice to 1/3 hamburger and feed at intervals through out the day until stools firm up or add some canned 100% pumpkin to their soft food. ProBios are also very good to add to your cat/kittens food as needed. You can purchase it at revivalanimal.com

Upper respiratory:
Kittens may stress when shipped or when they are going to a new home. Occasionally they may start to sneeze, cough or have runny sore eyes. If this occurs they should be seen by a vet immediately. A kitten can get very sick, very fast if not treated promptly. Sphynx do not generally respond to amoxicillin. Please contact your breeder for questions on upper respiratory symptoms.
Please do not hesitate to call me for any questions regarding your new addition!!!!
